摘要
2018年9-10月期间,贵阳市乌当区卫生和计划生育局对3例非法行医行政处罚决定书提出了强制执行申请,但连续被乌当区法院裁定不准予执行,暴露了当前卫生行政执法行为的不合法性与执法风险,既损害了卫生行政部门执法权威,影响了行政管理效能,又浪费了行政资源和司法资源,理应进行深刻反思和总结。从执法主体、执法程序、执法要件等方面对该批判例进行综合分析,针对卫生行政执法执行时效方面存在的法律问题,提出相应对策。
During the September-October in 2018,Guiyang Wudang District Health and Family Planning Bureau filed a petition for compulsory execution of 3 administrative penalty cases of illegal medical.But Wudang District Court continuously ruled that don′t allow execution,which exposed the current health administrative law enforcement activities of legitimacy and law enforcement risk.It not only harmed the authority of the department of health law enforcement,but also affected the administrative efficiency,wasted of the administrative and judicial resources.It need to be deep reflected and summarized.From the law enforcement body,this paper analyzed law enforcement procedures,law enforcement and the elements of the critical requirement,aiming at the existing law of health administrative law enforcement and enforce the aging problem,to put forward the corresponding countermeasures.
