卫生执法视角下的行刑衔接制度探析

Analysis of the system of execution of sentence from the perspective of health law enforcement

行刑衔接是我国法治建设进程中的一项重要工作,是完善社会主义法制体系的必然要求。以卫生执法为视角,梳理行刑衔接制度涉及的主要案件类型和卫生、刑法相关法律,分析归纳出卫生领域中行刑衔接的五种主要适用范围,同时对行刑衔接制度面临的不具有期待可能性、信息不对称、证据转化等问题提出思考和建议,为卫生领域中行刑衔接制度的完善提供一定参考。

The connection of execution is an important task in the process of legal construction in China and an inevitable requirement for perfecting the socialist legal system.From the perspective of health law enforcement,this paper sorted out the main types of execution connection system and the relevant laws and regulations on health and criminal law.It analyzed and summarized the five main scopes of execution in the field of health,and didn’tn have the expectation of the execution system.Thoughts and suggestions on information asymmetry and evidence transformation provide a certain reference for the improvement of the execution system in the health field.
