Analysis and Discussion on Current Situation, Problems and Countermeasures of Local Legislation in the District: Taking Shandong Province as an Example

2015年新修改的《立法法》明确赋予设区的市地方立法权,使地方立法权从原先较大的市下放到设区的市,设区的市成为一个独立的立法层级。新的《立法法》赋予其立法权给设区的市既带来了机遇也带来了新的挑战。自2015年至今,设区的市拥有地方立法权已4年多,在近几年的立法过程中也暴露了一些问题。文章将以山东省设区的市为例,通过统计山东省4年多设区的市地方性法规的数量,分析研究山东省设区的市在立法中存在的问题,并提出相应的解决对策。

The newly revised Legislation Law in 2015 clearly stipulates the local legislative power of the district,so that the local legislative power is decentralized from the original larger city to the district-based city,and the district-based city becomes an independent legislative hierarchy. The new Legislation Law gives it the legislative power to bring opportunities and new challenges to the city. Since 2015,the city of the district has been close to five years of local legislative power,and some problems have been exposed in the legislative process in recent years. This article will take the city of Shandong province as an example to analyze the problems of the local legislation of Shandong province in the past five years,and analyze the problems existing in the legislation of the city of Shandong province,and propose corresponding solutions.
