摘要 随着"摩尔定律"带来的计算机算力及算法技术水平的提升,人工智能写作获得了长足进步。其在当下的场景运用呈几何级数增长,由此引发了人工智能写作机器人"作者"法律主体地位的问题。这不仅关乎如何规范机器人写作的问题,更关系到如何在人工智能与人的竞争关系中保护人类写作者的主体地位。为此,需要对人工智能写作机器人创作的历史、现状进行深入研究,就如何确认人工智能写作机器人的"作者"主体资格进行深入辨析,对其未来发展作出科学预测,充分认识其对人类写作者和读者知情权的挑战。 With the improvement of arithmetic and arithmetic technology brought by Moore’s Law, artificial intelligence writing has made great progress. Its application in the current screne is increasing in geometric progression, which leads to the problem of the legal subject status of the artificial intelligence writing robot "auther". This is not only about how to regulate robot writing, but also about how to protect human writers’ subjective status in the competitive relationship between artificial intelligence and human beings. Therefore, we need to deeply study the history and current situation of AI writing robots’ creation, make a thorough analysis on how to confirm the main qualification of AI writing robots as "authers", make a scientific prediction of their future development, fully understand their challenges to human authors and readers’ right to know.
