On Improving the Credibility of the Civil Judicial Appraisal

民事诉讼中司法鉴定公信力的主要影响因素在于鉴定质量、鉴定意见采信率、重复鉴定、鉴定机构的公益性质、鉴定机构和鉴定人的社会评价、民事闹鉴行为等方面。所以,要提高和保障民事司法鉴定的公信力,应当加强司法鉴定立法与体制建设、完善民事司法鉴定的监督与救济、加强鉴定机构质量体系建设与内部管理、加强司法鉴定行业协会与诚信档案建设等多措并举,同时注意坚持“程序正义”和“科学正义”的理念,避免“以鉴代审”,并且合理处置“民事闹鉴”行为。

The factors that affect the credibility of civil judicial appraisal include:the quality of appraisal,the adoption rate of appraisal opinions,repeated appraisal,the public nature of appraisal institutions,and social evaluation of appraisal institutions and appraisers.In order to improve and guarantee the credibility of the civil judicial appraisal,judicial expertise legislation and system construction shall be strengthened,supervision and remedy of civil judicial appraisal should be perfected,the quality system construction of appraisal institutions and internal management should be reinforced,and the construction of judicial appraisal industry association and credit archives should be promoted.Besides,we should adhere to the principle of"procedural justice"and"scientific justice",avoiding replacing trial with appraisal,and also we should appropriately handle incidents of disturbance over appraisal opinions.
