黑恶势力犯罪亚文化再审视

Review on Criminal Subculture of Black Evil Forces

学界对于扫黑除恶的政策解读、路径手段等研究颇多,但对黑恶势力犯罪亚文化形成这一根源性问题却鲜有问津。对黑恶势力犯罪亚文化的分析具有犯罪治理意义和刑事政策意义。厘清主流文化与犯罪亚文化之间的关系,从纵向和横向两个维度,将历史与现实文化基因相结合,有助于形成具有问题意识的本土化的犯罪亚文化理论。我国黑恶势力犯罪亚文化是主流文化异化的结果,具有传统和现代文化基因,应从完善黑恶势力认定体系、挖掘正向传统文化基因、净化网络传媒环境、畅通诉求表达渠道四个方面予以治理。

The announcement of the notice on the special struggle against crimes against black forces and evil laid the general tone of the current fight against crime and black forces. There are many studies on policy interpretation, approaches of the fight against black forces and evil forces in the academic world, but few studies on the root cause of the formation of the subculture of crimes against black forces and evil forces. On the basis of clarifying the relationship between mainstream culture and criminal subculture, this paper analyzes the causes of criminal subculture of black and evil forces from both horizontal and vertical dimensions, combines historical and realistic cultural genes, and forms a localized crime subculture theory with problem consciousness. To control the criminal subculture of the black and evil forces, it is necessary to improve the identification system of the black and evil forces, explore the positive traditional cultural genes, purify the network media environment, and smooth the channels of appeal expression.
