超出仲裁请求的审查与认定

尽管超出仲裁请求并非我国法律明确列出的不予执行及撤销仲裁裁决的事由,但是根据司法解释及复函的规定,超出仲裁请求可能导致仲裁裁决被撤销及不予执行。不过,由于仲裁庭认定事实和适用法律均属于行使仲裁权的范围,我国法院支持裁决超出仲裁请求的主张比较少见。

Although not expressly stated in the statutes of the PRC, extra petita is one of the legal grounds to withdraw and not to enforce arbitral awards in China, according to interpretations and replies issued by the Supreme People’s Court of China. Nonetheless, given the fact that ascertaining facts and applying law is within the power of arbitrators, Chinese courts have been reluctant to accept claims that the arbitrators exceeded the scope of the parties’ submissions.
