适用于医药生物领域审查阶段的专利价值评估体系的建立与验证 被引量:2

摘要 专利价值评估体系是通过科学的方法,对专利价值进行量化的过程,是高价值专利培育工程的基础和前提。现有的专利价值评估体系大多缺乏领域特色,不利于审查员在专利审查的同时快速、准确地筛选出高价值专利。本文基于专利审查员在审查实践中的体会,综合考虑医药生物领域的特殊需求和审查实践中遇到的领域特色问题,依托现有的文献、书籍及网络资料,从“领域特色”和“审查相适”两个角度选取和改进评估指标,最终建立起适用于医药生物领域审查阶段的特有的专利价值评估体系。利用该体系对生物药授权案例进行验证的结果表明,通过本体系能够帮助医药生物领域审查员有效地挖掘高价值专利,具有重要意义。 The patent value evaluation system is a process of quantifying the value of patents through scientific methods, and is the basis and premise of high-value patent cultivation projects. Most of the existing patent value evaluation systems lack fi eld characteristics, which is not conducive to the examiner's rapid and accurate screening of high-value patents while patent examination. This paper is based on the actual examination experience in practice of patent examiners, and the particular writing requirements and examination characteristics in the field of medicine and biology has been taken into comprehensive consideration. Meanwhile, indicators have also been seleted by referring to the existing literature, books and network materials. After that, the indicator is researched and improved from the perspectives of "domain characteristics" and "review appropriateness". The evaluation indicators finally established a unique patent value evaluation system suitable for the examination stage of the medical and biological fields. The use of this system to verify the case of biopharmaceutical authorization patents shows that it is of great significance to help the examiners in the medical and biological fields to effectively mine high-value patents.
