This article discusses the judgment of the common knowledge, including: motivation problem is to determine whether those skilled in the art have the motivation to modify the reference document;realization problem is to determine whether the current claim can be obtained by modifying the reference document;and means problem is whether the technical means used to modify the reference document to obtain the current claim is the common knowledge. Further, this article analyzes the important role of the judgment of the common knowledge in the process of judging inventiveness with specific cases, and hopes to provide some help for the judgment of inventiveness.
