“星期狗”纠纷法律问题分析与对策研究

Analysis on Legal Disputes of “Weekly Dogs” and Study on Relevant Countermeasures

“星期狗”现象日益引起社会关注,购犬者维权难的同时,也造成了行业监管之困。本文通过研究18起“星期狗”民事审判案例,分析了发生纠纷的民事解决机制,着重研究了犬只销售监管职责分工、举报投诉处理及对销售染疫犬只行为如何惩处等相关行政法律问题,为执法人员依法行政提供监管思路,这提示应加强犬只来源地动物防疫监管,规范犬只销售行为,完善犬只销售纠纷解决机制。

Recently,public concerns have been increasingly raised by the issues of“weekly dogs”,which have brought difficulties to buyers to protect their rights and great troubles to supervision of the industry. In this paper,18 civil cases of“weekly dogs”were studied,the settlement mechanism for relevant disputes was analyzed,and relevant administrative legal issues were emphatically analyzed,including the assignment of supervision responsibilities for any dog sale,mode of dealing with complaints and tip-offs,as well as how to punish illegal sale of infected dogs,etc., therefore,some references could be provided for law enforcement officers. Further,some suggestions were given that supervision over control of animal diseases at dogs' origin places should be strengthened,any sale of dogs should be standardized and the settlement mechanism for relevant disputes should also be improved.
