人工智能的运用有助于司法效率的提高,但其技术属性阻碍了人工智能与司法的进一步结合。探寻人工智能进入司法路径应从两者的冲突观察入手,基于两者的固有属性,从人工智能如何适应司法及司法如何面向人工智能两个角度展开分析,推动技术知识与法学知识的深度融合,明确科技介入司法领域的边界,同时需加强复合型人才的培养及司法数据库的构建。

The use of artificial intelligence contributes to the improvement of judicial efficiency, but its technical attributes hinder the further integration of artificial intelligence and justice. To explore the path of artificial intelligence entering the judicial system should start from the conflict between the two. Based on the inherent attributes of the two, this paper analyzes how the artificial intelligence adapts to the judicial system and how the judicial system faces the artificial intelligence, promotes the deep integration of technical knowledge and legal knowledge, and clarifies the boundary of science and technology involved in the judicial field. Meanwhile, it is necessary to strengthen the cultivation of interdisciplinary talents and the construction of judicial database.
