雄安新区产业转移升级法治保障研究

Research on the Legal Protection of Industrial Transfer and Upgrading in Xiongan New Area

法治是促进产业政策培育与发展的终极保障,雄安新区产业转移升级必须借助于科学法治体系的强力支撑,这不仅有助于推进其产业政策制定的民主性与科学性、推进产业政策实施的权威性与效率性、推进营商环境的现代性与国际性,而且有助于推进京津冀地区产业发展的战略性与协同性。鉴于此,有必要在明晰当前雄安新区产业转移升级法治保障问题的基础上,确立软法与硬法共治的产业发展协同治理思想,推进以高新技术产业发展、低端产业转移以及产业政策评估为核心的主导产业制度建设,同时也要围绕着金融、税收、行政管理、知识产权保护、住房与土地供给以及生态环境保护等相关内容推进产业发展的配套性法律制度建设。

The rule of law is the ultimate guarantee for the promotion and development of industrial policies. The industrial transfer and upgrading of Xiongan New Area must rely on the strong support of the scientific rule of law system,which not only helps to promote the democratic and scientific nature of its industrial policy formulation,but also promotes the implementation of industrial policies. Authoritativeness and efficiency, promoting the modernity and internationality of the business environment,and helping to promote the strategic and synergistic development of the industrial development in the Beijing-Tianjin-Hebei region. In view of this,it is necessary to establish the idea of coordinated development of industrial development between soft law and hard law on the basis of clarifying the current problem of industrial transfer and upgrading of the rule of law in Xiongan New Area,and promote the development of high-tech industries,low-end industries and industrial policies. The evaluation is the core construction of the leading industrial system. At the same time,it also needs to focus on the construction of supporting legal systems for industrial development, such as finance,taxation,administrative management,intellectual property protection,housing and land supply,and ecological environmental protection.
