非法拘禁被害人自杀案件的司法认定 被引量：1

摘要 非法拘禁的被害人在被拘禁时自杀是否属于结果加重犯,司法实践中意见不统一.笔者认为,虽然都有死亡结果出现,但自杀行为不具有通常性,因此自杀死亡与一般情况下非法拘禁“致人死亡”有区别,不能当然地认定自杀死亡必然是非法拘禁“致人死亡”的结果加重犯.本文通过对因果关系、主观心态和自杀原因进行分析,进一步明确上述结论.
