关于建立我国科技报告知识产权制度的思考 被引量:2

Study on the Construction of Intellectual Property Rights System of Chinese Scientific and Technical Report

摘要 科技报告是我国拥有自主知识产权的创新成果。科技报告知识产权制度是国家科技报告制度的有机组成部分。严格保护科技报告知识产权,可以有效激励创新,有利于落实知识产权强国战略,对统筹管理国家科技计划项目成果,制定统一的知识产权制度具有参考借鉴作用。运用案例分析方法,分析阐述法律及政策中存在着科技报告作品性质界定难,著作权归属判定难,知识产权保护难等问题。认为将科技报告作为单独的作品类型纳入著作权法,加强国家科技计划项目知识产权理论与实践研究,是解决现存问题切实可行的路径。 Scientific and technical report is the innovation outcome that is independent intellectual property rights of our country.The intellectual property rights system of scientific and technical report is an important part of the national scientific and technical reporting system.Strictly? protect the intellectual property rights of scientific and technical report is effectively stimulate innovation,is helpful to implementing intellectual property power strategy,and provides a good reference for overall management of the achievements of national scientific and technical program projects and unified intellectual property system at sametime.By the method of case analysis,elaborating and analyzing some problems in correct laws and policies such as difficulty in defining the nature of scientific and technical reporting works,?difficulty in judging the ownership of copyright?,difficulty of intellectual property protection? and so on.It is a practical way to solve the existing problems through incorporating scientific and technical report into the copyright law as a separate type of work,strengthen the study of intellectual property rights theory and practice of national scientific and technical program projects.
