Research on the Ownership of Technical Intellectual Property

技术类知识产权的权属确定是对其进行使用、处分、交易的基础,是在技术交易过程中进行风险防范的第一道防线。通过界定技术类知识产权的内涵、特点,讨论权属判断时可能会涉及的权利主体,梳理实践中存在的技术类知识产权权属问题,结合相关的法律规定、法院裁判和理论研究,可以发现技术类知识产权权属问题存在的风险,并采取相应的防范对策。

The determination of the ownership of technical intellectual property is the basis for its use,disposal and transaction and the first level of defense against the risk during the technical trading.By defining the connotation and characteristics of technical intellectual property rights,this paper discusses the rights subject that may be involved in the judgment of ownership,and sorts out issues concerning the technical intellectual property rights in practice.By studying some relevant legal provisions,court decisions and theoretical research,it also comes up with some measures to prevent the risks against technical intellectual property rights issues.
