拉美国家的反腐败国际合作研究

Research on International Cooperation against Corruption in Latin American Countries

作为融入全球化浪潮比较早的发展中地区,拉美国家的国际反腐合作开展较早亦较为深入。虽然当前拉美国家的反腐败形势仍然不容乐观,但其在国际上加入各种反腐败公约,同时在国内制定相应的反腐败法律,在一定程度上打击了腐败,甚至在国内掀起了一波又一波的反腐败高潮。当然,拉美国家国际反腐败合作仍然存在亟待解决的问题与挑战,如反腐败规定的多样性与复杂性、反腐败公约的多样性和各国对公民数据隐私的法律保护等造成了反腐败国际合作风险的复杂性,需要各国协调立场,统一对腐败问题的认识,聚焦规则和制度的转型,使反腐败规定标准化,加强司法协助,促进国际反腐败合作的深入发展。

As a developing region with a long wave of integration into globalization, the international anti-corruption cooperation of Latin American countries has been carried out earlier and in greater depth. Although the current anti-corruption situation there is still not optimistic, the countries have acceded to various anti-corruption conventions at the international level, while enacting corresponding anti-corruption laws at home which is favorite to combat corruption and even set off a wave of anti-corruption climax in the country. Of course, there are still pressing issues and challenges in this aspect, such as the diversity and complexity of anti-corruption provisions, the diversity of anti-corruption conventions and the legal protection of citizens’ data privacy by States, which create the complexity of the risk of international cooperation against corruption. Therefore, it is necessary for states to coordinate their positions and to harmonize awareness of corruption, focus on the transformation of rules and systems, standardize anti-corruption provisions, strengthen mutual legal assistance, and promote the in-depth development of international anti-corruption cooperation.
