摘要
《立法法》第13条“法律暂时调整和停止适用”的规定,乃是由改革实践所塑造的规范。该规定赋予全国人大及其常委会调整或停止法律适用的职权,同时设置了主体、目的、范围、时空、方式和幅度等诸多限制性要件。基于规范的实践考察表明,法律暂时调整和停止适用的既有实践,大体上符合此类要件,但仍不乏诸多“失范”现象。鉴于实践中的“失范”在很大程度是因规范的不完满所致,加之能动的实践已然拓展了规范的原初内涵,为此,有必要结合实践调试《立法法》的相关规定。
Article 13 of the Legislation Law stipulates that "temporary adjustment and cessation of application of law" is a norm shaped by reform practice.The provision gives the NPC and its Standing Committee the power to adjust or stop the application of law,and set up many restrictive elements such as subject,purpose,scope,time and space,mode and range.Practical investigations based on norms show that the existing practice of temporary adjustment and cessation of application of law generally conforms to above requirements,but there are still many "anomie" phenomenons.As the "anomie" in practice is often due to the imperfection of the norm,and the active practice has expanded the original connotation of the norm,it is necessary to adjust the relevant provisions of the Legislation Law in combination with practice.
