当前我国劳动争议的特点与工会作用发挥

劳动争议的数量和特点与当时的经济社会环境、法制环境、国家政策等息息相关。2018年我国的劳动争议数量仍呈高位运行状态,而且各地劳动争议数量差异较大;劳动争议案件的成因与经济政策呈现高度关联性,极易引发群体性劳动争议;民营企业、小微企业劳动争议较多;劳动争议案件纠纷类型多元化、复杂化和复合化;高层劳动者涉案数量快速增长,类型新颖;以互联网平台企业为中心的新类型案件增多,案件处理难度增大。未来劳动争议数量将继续保持较大幅度增长,群体性劳动争议可能会进一步增多、劳动争议类型会更加多元和复杂。工会应充分利用自身优势,督促企业进行合法合规的自省,加强劳动争议的预防,并积极投入到劳动争议多元处理格局中去。

The number and characteristics of labor disputes are closely related to the economic and social environment, legal environment and national policies at that time. In 2018, the number of labor disputes in China is still at a high level, and the number of labor disputes varies greatly from place to place;the causes of labor disputes are highly related to economic policies, and easily lead to group labor disputes;there are more labor disputes in private enterprises and small and micro-enterprises;the types of labor disputes are diversified, complicated and compounding;the number of high-level workers involved in cases is growing rapidly and the types are novel;the number of new types of cases centered on internet platform enterprises is increasing, and the difficulty of handling cases is increasing. In the future, the number of labor disputes will continue to increase substantially. Group labor disputes may increase further,and the types of labor disputes will become more diverse and complex. Trade unions should make full use of their own advantages, urge enterprises to conduct self-examination of legitimate compliance, strengthen the prevention of labor disputes, and actively participate in the multi-processing pattern of labor disputes.
