监察体制改革背景下人民监督员制度回溯与检视

Retrospection and Review of the People’s Supervisor System Under the Background of Supervision System Reform

2016年11月中办印发开展国家监察体制改革试点方案,在此背景下以检察机关自侦权为监督对象的人民监督员制度处于十字路口,围绕司法民主化与司法职业化所开展的对人民监督员制度的争论不断上演。通过对人民监督员制度的设立背景及价值取向进行回溯,分析在当前监察体制改革背景下人民监督员制度在实践层面所遭遇的问题及在新时代所面临的期待,从实践与理论角度重新检视人民监督员制度,提出人民监督员制度作为富有中国特色的公民参与司法的重要制度载体仍具有实践价值。

In November 2016,the Central Office of the People’s Republic of China issued a pilot program for the reform of the national supervision system. Under this background,the people’s supervisor system with the procuratorial offices’ self-investigation power as the object of supervision is at a crossroads,either it is the judicial democratization or the judicial professionalization. The debate over the people’ supervisor system continues to be staged. By reviewing the background and the value orientation of the people’s supervisor system,this paper analyzes the problems encountered by the people’s supervisor system in the practical level and the expectations in the new era in the context of the current monitoring system reform,re-examines the people’s supervisor system from practice and theory,and proposes that the people’s supervisor system still has practical value as an important institutional carrier with Chinese characteristics for citizens to participate in justice.
