摘要
在明朝“礼法合治”的社会治理模式中,礼具有根本性地位,法处于礼的依附性地位。明代民间诉讼的审判并非严格按照法律条文对案件做出审理,而是以维护儒家社会道德秩序为宗旨,以“引经决狱”为特征,以是否违反儒家的道德规范作为听讼、断狱的标准,诉讼当事人所接受的与其说是法律的审判毋宁说是道德的教化。新时代促进国家治理体系和治理能力现代化,必须借鉴中国传统礼法文化中的优秀内核,重新认识“道德教化”在新时代中国特色社会主义建设中的重要意义与巨大功能,并为道德教化的有力彰显建构制度化路径体系。
Confucianism edification is the process of morals that the Confucianists promote penetrates the grass roots and gains its folk conformation. When the local officials heard the civilian lawsuits,they had the conclusions on the bases of Confucian morals instead of the law rules. To the local officials,the aim was to protect the Confucian community moral order. To build a socialist country under the rule of law and to promote the modernization of the national governance system and governance capability,we need to draw on the excellent core of the Chinese law and ethics.
