摘要
异议登记作为不动产登记的一种特殊类型,通过暂时阻却登记公信力,排除第三人善意取得,保护真正权利人;但并不因此推翻登记的推定力,而是通过均衡申请人、登记权利人和第三人的关系,达到保护交易安全的效果。《物权法》构建了异议登记制度的基本框架,但由于缺乏明确具体的规定,这一制度运行过程中在申请、审查和效力等环节均存在缺陷和争议。应放宽在申请范围上的限制,明确申请材料的内容和标准,采用合理审慎的审查模式,削弱异议登记产生的限制力,不应限制登记权利人的处分权。
As a special type of real estate registration,objection registration protects the real right person by temporarily blocking the public credibility of registration and excluding the third party’s bona fide acquisition.However,it does not overthrow the registration presumption,but conversely achieves the effect of protecting the security of the transaction through balancing the relationship of applicant,registered obligee and the third party.Although the Real Right Law has established the basic framework of the objection registration system,there exist defects and disputes in the application,review and effectiveness of the system due to the lack of clear and specific regulations.The restrictions on the scope of application should be relaxed,and the content and standards of the application materials need to be clarified.Simultaneously,the pattern of reviewing should be reasonable and prudent and a weaken restriction of objection registration should be adopted.The right of disposition of the registered obligee should not be restricted.
