新时代地方生态环境法规体系构建研究——兼谈对中央生态文明法律体系建设的启示

Research on the Construction of Local Ecological Environment Regulation System in the New Era——Discussion on the Enlightenment to the Construction of the Central Eco-civilization Legal System

构建新时代地方生态环境法规体系应以“生态文明”入宪、地方立法权限扩容、生态环境主管部门职能改革为时代背景,透过G省生态环境法规体系构建的实践经验,发现地方生态环境立法存在上位法授权不足、法规体系内部不协调等问题,要构建生态环境法律体系,先要实现体系化,可以制定《生态文明建设促进法》,在中央生态文明法律体系构建中需尊重生态规律,坚持“法律保留”和“地方保有”,横向规范采用“综合法—单行法”分类模式,补强生态系统保护单行立法。

The construction of a new era local ecological environment regulation system should be based on the“ecological civilization”constitution,the expansion of local legislative powers,and the reform of the functions of the ecological environment authorities.There are problems such as insufficient authorization of the upper-level law and internal uncoordinated laws and regulations through the practical experience of the G provincial ecological environmental regulations system.To build an ecological environment legal system,we must achieve systematization and formulate the Law on the Promotion of Ecological Civilization Construction.In the construction of the central ecological civilization legal system,we must respect the ecological laws,adhere to the“legal reservation”and“local possession”,horizontally adopt the“comprehensive method-single-line method”classification model and strengthen the single-line legislation to protect the ecosystem.
