计算机软件产业行政保护的立法不足与完善探究

Research on the Insufficient Legislation of Administrative Protection of Computer Software Industry and its Improvement

伴随计算机技术在各行业领域中的广泛应用,对计算机软件产业行政保护提出更高的要求.从目前行政保护立法实际看,虽然出台较多相关法律,对引导计算机行业发展可发挥重要作用,然而单纯从计算机软件产业实际看,仍有较多立法不完善之处,极大程度上制约软件产业行政保护水平提高,这就要求在立法方面不断完善.本次研究将对计算机软件产业行政保护立法相关概念界定,立足于当前计算机软件产业行政保护立法现状,提出计算机软件产业行政立法保护相关建议.

With the wide application of computer technology in various fields, higher requirements are put forward for the administrative protection of computer software industry. From the practices of administrative protection legislation, although more relevant legal regulation to help guide the computer industry development can play an important role, just look from actual computer software industry, however, there are still more imperfect legislation, administrative protection levels increase largely restricted software industry, which requires the perfect in legislation. This study will define the relevant concepts of administrative protection legislation of computer software industry, and based on the current situation of administrative protection legislation of computer software industry, put forward relevant suggestions on administrative legislation protection of computer software industry.
