我国环境污染责任保险制度建设研究

Research on the Construction of Environmental Pollution Liability Insurance System in China

本文系统研究我国环境污染责任保险制度构建问题。首先,阐述了我国现行环境污染责任保险制度的相关概念,包括其特点、立法过程和发展现状;其次,研究了现行环境污染责任保险制度存在的不足之处,包括企业缺乏环保知识、相关法律制度不完善和缺乏专业技术等;随后,总结了国外环境责任保险发展的经验,包括应立法先行,在强制与自愿并施的制度下,适当延长施行期限、科学组建承保机构等经验;最后,在上述分析的基础上,提出了包括国家应在政策扶持下进行商业化运作,保险机构应建立责任挂钩约束机制,投保企业应加强与保险机构的风险管理合作等可行的建议。

This paper systematically studies the construction of China's environmental pollution liability insur. ance system. Firstly, it expounds the related concepts of China's current environmental pollution liability insurance system, including its characteristics, legislative process and development status. Secondly, it studies the shortcom. ings of the current environmental pollution liability insurance system, including the lack of environmental protection knowledge, the imperfections of related legal system and the lack of professional skills. Subsequently, this paper sums up the experience of the development of foreign environmental liability insurance, including the need to legis. late first, and under the system of mandatory and voluntary implementation, we should appropriately extend the im. plementation period and scientifically form underwriting institutions. Finally, on the basis of the above analysis, it is proposed that the state should carry out commercial operation under the policy support, the insurance institutions should establish a responsibility-binding constraint mechanism, and the insured enterprises should strengthen the risk management cooperation with the insurance institutions.
