军事行政执法机制改革研究

On reform of mechanism for enforcement of military administrative law

在新时代背景下,军事行政执法作为军事法治体系中的重要一环,有必要审视其存在的主要问题,并有的放矢地进行改革,以适应构建中国特色军事法治体系的要求。当前,法治意识不强、机关责权不明确、执法透明度不高、执法力度不严、法律保障不力、监督机制不健全、救济机制不完善是存在的主要矛盾,建议从培养法治思维和法治方式、明确机关权责边界、增强军事行政执法透明度、坚持全面从严治军、建立军事法律顾问制度、健全军事行政执法监督机制,并从完善信访制度、改革军事行政申诉制度、建立军事行政复议制度、推广军事行政诉讼制度四个方面完善军事行政执法救济制度。

Enforcement of military administrative law is an important part in the system of military laws. In the new era it is necessary to recognize the existing problems in this respect so as to carry out the reform and to adapt to the requirements of constructing the system of military laws with Chinese characteristics. At present, the problems present themselves mainly as the weak law awareness, vague institutional responsibility, loose and non-transparent law enforcement, ineffective legal protection, imperfect supervision mechanism, and unsatisfactory relief mechanism as well. It is suggested that we should cultivate the thoughts and conception of ruling by law, clarify the boundary of institutional authority and responsibility, enhance the transparency of enforcement, persist in running the army in an all-round and strict manner, establish a system of military legal advisers, complete the supervision mechanism, improve the system of petition letters and visits, reform the system of military administrative appeals, establish a system of military administrative review, and promote the system of military administrative litigation to improve the relief system of military administrative law enforcement.
