我国传统“行政主导型”的征地补偿模式实际上是计划经济社会历史条件下的产物,带有明显的管理主义特征。新时代背景下以“同地同权”、赋权于“民”为基本价值理念的土地管理制度改革恢复了国有土地与集体土地法律地位平等的宪法秩序,确立了农民作为集体所有权享有者与行使者的主体地位,从而改变了传统征地补偿模式赖以生存的社会土壤,并为“参与协商型”行政法治模式的引入和征地补偿模式的重构提供了基础和条件。“参与协商型”征地补偿模式具有以人为中心、注重多元利益主体实质参与征地补偿决策、追求公平正义等明显的治理主义特征。与之相适应,征地补偿制度框架应遵循公益征收原则建立征收、征购双轨制,贯彻公平合理补偿原则建立主客观面向相配合的补偿标准,完善征补程序保障多元利益主体的参与协商权利。
