ISM规则中证书“有效性终止”条款在大陆与港澳台地区的履约对比分析

Contrastive analysis on the implementation of certificate “Validity termination” clause in ISM Code in mainland and Hongkong,Macao,Taiwan Region

文中对《国际船舶安全营运和防止污染管理规则》(下文简称“ISM规则”)关于《符合证明》和《安全管理证书》的“有效性终止”的条款进行了分析研究。结合目前我国行政法规体系的基本理论,分析了我国大陆地区的对该条款的转化历程以及现有的可行的履约方式。最后,对比分析了大陆地区和港澳台地区对ISM规则关于证书“有效性终止”条款的履约转化的异同情况。在此基础上,提出了构建符合我国国情的证书“有效性终止”法律制度体系的几点建议。

The paper analyzes and studies the articles in the International Management Code for the Safe Operation of Ships and for Pollution Prevention(ISM)on the"termination of validity"of Document of Compliance and Safety Management Certificate.In view of the basic theories of the current administrative law system in China,it analyzes the transformation process of this provision in China's Mainland and the existing feasible ways to implement it.Finally,the paper makes a comparative analysis on the similarities and differences between China's Mainland and Hong Kong,Macao and Taiwan in the implementation and transformation of ISM code concerning the clause on the termination of certificate validity.On such a basis,suggestions are put forward to construct the institutionalized certificate validity termination system.
