互联网环境下知识产权冲突法面临的新问题及其国际应对

New Problems and International Countermeasures of Intellectual Property Conflict Law under the Internet Environment

互联网技术对传统知识产权实施方式形成真实的挑战,知识产权冲突法新问题直接导致国内知识产权判决无法在外国获得承认与执行。本文通过分析当事人选购法院、法院过度管辖以及法律适用上地域性方法的异化等知识产权冲突法面临的新问题,论述海牙国际私法会议其判决公约草案涉知识产权条款,特别是其新近草案中涉网知识产权判决的承认与执行规定,解释其实施对于减少知识产权国际平行诉讼,防止当事人恶意选购法院甚至抑制受案法院扩大适用本国法的实质意义。

Internet technology forms a real challenge to traditional enforcement of intellectual property.The new problem of intellectual property (IP) conflict law directly leads to the inability of domestic IP judgment to be recognized and implemented in foreign countries.This paper analyzes new problems of IP conflict law such as forum shopping by the parties,excessive court jurisdiction and the alienation of regional methods in the application of law,discusses IP-related clauses in the draft of Convention on the Recognition and Enforcement of Foreign Judgments in Civil or Commercial Matters)of Hague Conference on Private International Law,especially the recent draft on internet- involved provisions relating the recognition and enforcement of foreign IP judgments,and explains the substantial significances of the enforcement of the related clauses to reduce IP international parallel proceedings,prevent the parties from malicious forum shopping or even restrain the court from expanding its application of domestic laws.
