智能驾驶汽车侵权的法律问题探讨

智能驾驶汽车是我国汽车产业转型升级的重要模式,随之而来的智能驾驶汽车侵权问题却成为了当下法律制度的难题。在分析智能驾驶汽车独特性的基础上,比对我国现有法律体系下可能的解决途径,确定以产品责任调整智能驾驶汽车侵权问题是当下的最优解。不过,现行产品责任调整智能驾驶侵权的配套制度并不完善。首先,应由国家颁布智能驾驶汽车强制性质量标准并强制智能驾驶汽车加装“黑匣子”来衡量产品缺陷;其次,有条件地适用“发展风险抗辩”原则来避免该免责条款滥用的情形发生;最后,设立强制责任保险制度以形成多维度、多层次的救济方式来解决智能驾驶汽车侵权问题。

Intelligent driving vehicle is an important mode of transformation and upgrading of China's automotive industry,and the consequent infringement of intelligent driving vehicle has become a difficult problem in the current legal system.Based on the analysis of the uniqueness of intelligent driving vehicles,this paper compares the possible solutions under the existing legal system of our country,and determines that adjusting the infringement of intelligent driving by product liability is the best solution at present.However,the current matching system of product liability adjustment for intellectual driving infringement is not perfect.First of all,the state should promulgate the mandatory quality standards for intelligent driving vehicles and force the installation of “black boxes” to measure product defects.Secondly,conditional application of the “development risk defense” exemption clause to avoid abuse.Finally,the compulsory liability insurance system forms a multi-dimensional and multi-level relief way to solve the problem of infringement of intelligent driving vehicles.
