医疗卫生领域违纪违法案件浅析与防控对策——基于95起违纪违法案例的分析

Analysis on the Situation of Violation of Law and Discipline in Medical and Health Fields and Countermeasures——Based on the analysis of 95 cases of violations

分析某省卫生健康委及委管省直单位发生的95起违纪违法案例,其中党员干部违纪违法人员占比高,手中握有一定权利的干部发生违纪违法的现象占比高,违反廉洁纪律者占比高,违法形式主要为受贿罪。违纪违法案件发生的原因有客观和主观方面:客观原因主要为行业"潜规则"诱惑,廉洁风险加大。主观原因有:教育效果不明显,理想信念缺失;制度体系不健全,监控力度薄弱;预防工作不全面,事前预警不足;履职能力不扎实,监督效果薄弱。根据案件发生原因,提出要从以下几个方面进行针对性的防控:加强教育引导,强化依法履职意识;完善制度建设,强化内部监督机制;完善平台建设,发挥科技预警效能;夯实队伍建设,提高自身履职能力。从而完善医疗卫生领域廉政建设,构建良好的政治生态。

This paper analyzes 95 cases of violations of law and discipline committed by a provincial health commission and the provincial direct units. Among them,party members and cadres have a high proportion of violations of discipline and law,and cadres with authority have a high proportion of violations of law and discipline. The proportion of disciplinary is high,and the illegal form is mainly the crime of accepting bribes. There are objective and subjective reasons for the occurrence of violations of discipline and law. The objective reasons are mainly: temptation of the industry’s"hidden rules",risk of integrity is increased. The subjective reasons include: educational effect is not obvious,lack of ideals and beliefs,institutional system is not perfect,monitoring intensity is weak,prevention work is not comprehensive,pre-warning is insufficient,performance ability is not solid,supervision effect is weak. According to the reasons of the case,it is proposed to carry out targeted prevention and control from the following aspects: strengthen education guidance and awareness of performing duties according to law;improve system construction,strengthen internal supervision mechanism;improve platform construction,develop early warning effectiveness in science and technology;improve the praty members’ ability to perform their duties.Thereby improving the construction of clean government in the medical and health field and building a good political ecology.
