人工智能创作的版权侵权问题研究

人工智能作为新时代科技革命的代表走进了人们的生活,也带来了版权领域的新问题。人工智能创作的本质主要通过计算机算法对大量作品样本进行解码、学习和训练,形成某种代表作品集规律的概率模型,并依此进行模仿和预测。人工智能所学习和复制的作品集规律可体现创作者对构成元素独创性选择和编排,具有可版权性,故其创作物存在版权侵权风险。其次,由于人工智能创作的特殊性,适用传统实质性相似标准认定侵权存在一定模糊性。建议引入市场替代标准辅助版权侵权认定,实质性相似与市场替代的结合,是判定人工智能创作版权侵权问题的最佳选择。

Artificial intelligence,as a representative of the technological revolution of the new era,has entered the lives of people and brought new problems in the field of copyright.The essence of artificial intelligence creation mainly uses computer algorithms to decode,learn and train a large number of sample works,to form a probabilistic model representing the rules of the collection.The rules of the collection of works learned and copied by artificial intelligence can reflect the creator’s original selection and arrangement of the elements,which is copyrightable.AI may be risk of copyright infringement.Due to the particularity of artificial intelligence creation,there is a certain degree of ambiguity in applying traditional substantive similarity standards to identify infringements.The author proposes to introduce market substitution standards to assist in the determination of copyright infringement.The combination of substantial similarity and market substitution is the best choice for judging the problem of artificial intellectual property creation copyright infringement.
