京津冀环境协同治理的法治路径与对策

Legal Approach and Countermeasure of Environmental Collaborative Governance for Beijing-Tianjin-Hebei

面对京津冀地区日益严重的环境污染,最有效的手段便是通过法律来进行协同治理。当前环境协同治理存在一些困境,环境协同立法不够协同,京津冀地区尚未建立良好的利益协同补偿机制,环境污染联合预警与信息共享措施不健全。生态环境协同治理问题背后是有深层次原因的,美国与日本的环境污染协同治理经验值得我们学习。要做好环境协同治理,需要环境协同立法,协调推进京津冀地区生态环境司法合作的新模式,构建多元化的主体协同治理模式与环境协同治理基金,建立京津冀地区环境信息共享平台,着力建设京津冀区域环境协同监测与监督制度,构建利益协调与利益补偿与环境协同治理的长效机制。要加大立法、司法与执法的保障力度。

Facing more and more serious environmental pollution from Beijing-Tianjin-Hebei,it is law for the most effective means of collaborative governance.The law of the current environment of collaborative governance has some trouble,there is not enough coordination in the legislation of environmental cooperation,and the sharing measures of joint warning and information of environmental pollution are not perfect.There are deep reasons behind the problem of collaborative governance for ecological environment.The experience of the United States and Japan in the collaborative treatment of environmental pollution is worth learning.To do a good job in environmental collaborative governance,it is necessary to make environmental collaborative legislation,promote the new mode of ecological and environmental judicial cooperation in the Beijing-Tianjin-Hebei region,and build a diversified model of collaborative governance,and build the environmental collaborative governance fund,the environmental information sharing platform will be established,and efforts will be made to build the regional environmental collaborative monitoring and supervision system,and to build a long-term mechanism of benefit coordination,benefit compensation and environmental collaborative governance.We will strengthen protection of legislation,justice and law enforcement.
