论司法权运行机制改革背景下新型司法监督体系的构建

Research on the Construction of New Judicial Supervision Mechanism under the Reform of Judicial Power Operation Mechanism

司法权作为重要的国家权力,其运行机制的健全直接影响公平正义的实现。在深化司法体制改革的过程中,司法权力的正确运行是其中的改革重点,要保障司法权力的有序行使,监督机制的建立和健全必不可少。在原有的监督机制中,检察机关的法律监督地位并未得到充分体现,司法权本身的配置不够合理,社会监督也存在诸多问题,影响了司法权力的有序行使。因而,在深化司法改革的过程中,需要进一步发挥检察机关的法律监督职能,司法职权的划分要更加合理,同时完善外部监督方式,最终构建出内外部协同运行的新型司法监督体系。

Judicial power is an important state power,and its operation mechanism directly affects the realization of fairness and justice.In the process of deepening the reform of the judicial system,the correct operation of judicial power is one of the key points of the reform.To ensure the orderly exercise of judicial power,it is essential to establish and improve the supervision mechanism.In the original supervision mechanism,the legal supervision status of procuratorial organs has not been fully reflected,the allocation of judicial power itself is not reasonable,and there are many problems in social supervision,which affect the orderly exercise of judicial power.Therefore,in the process of deepening judicial reform,the legal supervision function of procuratorial organs needs to be further developed,the division of judicial powers should be more reasonable,and the external supervision mode should be improved,so as to finally build a new judicial supervision system with internal and external coordination.
