法治与人伦：传统儒家法秩序的现代价值

Rule of Law and Human Ethics: The Modern Value of the Traditional Confucian Legal Order

传统“伦理法”所强调的人伦价值与现代法治并不矛盾,具体君臣父子的人伦关系或许随着时代发展而被社会所扬弃,但背后所蕴含尊重人伦,尊重生活情理的法律价值则将依然有着重要意义。当前,将社会主义核心价值观融入中国法治建设的具体思路可借鉴传统“伦理法”。传统“伦理法”的最大意义在于滋养了传统法所赖以生存的社会共识基础。儒家通过“化民成俗”的德教实践,将君臣、父子的人伦秩序内化为社会上人人所奉行的基本价值共识,并通过法律儒家化的过程将伦理与法律巧妙融为一体。而社会主义核心价值观在法治建设中发挥了社会价值“最大公约数”的重要意义,其凝聚社会共识的作用引导法治建设认知与实践的统一,使国家价值、社会价值与个人价值得到最大限度的通约。

The ethical value emphasized by the traditional "ethical law" does not contradict the modern rule of law. The emperor-minister and father-son ethical relationships may be abandoned with the development of the times, but the underlying legal values of respecting ethical relationship and being reasonable in everyday life will still be of great significance. At present, the concrete thinking of integrating socialist core values into the improvement of rule of law in China can draw upon the traditional "ethical law". The greatest significance of traditional "ethical law" lies in nurturing the basis of social consensus on which traditional law depends. Confucianism internalized the emperor-minister and father-son ethical order into the basic value consensus pursued by everyone in society through the moral practice of "influence the people and form moral customs", and integrated ethics and law skillfully through the Confucianizing process of law. The socialist core values play an important role in improving the rule of law, which is the "maximum common denominator" of social values. Its function of pooling social consensus leads to the unity of understanding and practice in the strengthening of the rule of law, and helps to find the largest common ground among the value of the country, society and people.
