我国台湾地区高校性骚扰防治机制镜鉴

On the Prevention and Treatment Mechanism of Sexual Harassment in Universities in Taiwan and Its Reference to Mainland

我国台湾地区高校性骚扰防治机制的内容主要规定在“性别平等教育法”“性别平等教育法施行细则”和“校园性侵害性骚扰或性霸凌防治准则”中,包括预防机制和防治机制两大方面。本文对台湾地区高校性骚扰概念及构成、高校性骚扰防治机制的内容及其特征和不足进行了分析评述,并以此为参照,结合大陆地区的社会现实基础,提出大陆地区在构建高校性骚扰防治机制时,应在法律中做出专门规定,明确高校的防治职责并设立专门机构,科学界定高校性骚扰概念,设置具有弹性的处理机制,注重预防和性别平等教育等建议。

The prevention and treatment mechanism of sexual harassment in universities in Taiwan is mainly regulated in Gender Equity Education Act, Enforcement Rules for Gender Equity Education Act, and Regulations to Prevent and Handle Sexual Assault, Sexual Harassment, or Sexual Bullying on Campus. It includes two aspects: prevention mechanism and treatment mechanism. This paper analyzes and comments on the concept of sexual harassment in universities, and the contents, characteristics and shortcomings of the prevention and treatment mechanism of sexual harassment in universities in Taiwan, and taking this as a reference,pointed out some suggestions on constructing the counterpart in the mainland, that is, to make special regulations on the sexual harassment in universities in laws, to define its concept scientifically, to clarify the duties of universities and to set up special institutions, to set up flexible treatment mechanism, to focus on prevention and gender equality education, etc.
