党内法规的效力位阶与冲突规避

Study on the Effectiveness Rank and Conflict Avoidance of CPC’s Inner-Party Regulation

随着党内法规建设的不断推进,目前已经形成了层级分明的党内法规效力位阶体系,主要可以从法规名称与制定主体两个角度加以区分。为防范与解决党内法规之间的效力冲突,《中国共产党党内法规制定条例》明确了上位规定优先、新规定优先、特别规定优先三项原则以及事前防范与事后控制机制,但相关规定仍需进一步完善。党内法规与规范性文件在形式特征方面存在差异,但调整内容有所重合,因此两者之间的效力关系也需予以专门分析。在论及党内法规效力问题时,还需要准确理解纪严于法、纪在法前的精神实质,即党内法规对党员的要求比法律要求更高,而且在对党员适用国家法律追究法律责任之前要先依据党的纪律追究党纪责任,不能简单理解为党纪效力高于国法,或适用党的纪律之后就不再适用国家法律。

With the continuous improvement of inner-party regulation construction,a hierarchical system about effectiveness rank has formed,which can be distinguished from two perspectives,the name of regulation and the decision-makingbody.In order to prevent and solve the conflicts between inner-party regulations,the Regulation on the Formulation of Inner-party Regulation of CPC has clearly defined three principles which include priority of superior regulation,priority of new regulation and priority of special regulation,along with the conflict-prevention mechanism and conflict-control mechanism,but relevant provisions still need to be refined.There are some differences between inner-party regulations and inner-party normative documents in terms of formal features,but at the same time there are overlaps in adjustment content,therefore the mutual effectiveness relationship needs to be specially analyzed.In regard to this issue,it’s also necessary to understand exactly the spiritual essence of a fixed expression that discipline is not only strict than but also precedes national law,namely the inner-party regulations put forward higher requirements to party members than the national law’s requirements to civilians,and inner-party regulations should be applied before national law.It doesn’t claim that inner-party regulations own high effectiveness than national law,nor national law don’t need to be applied after inner-party regulations applying.
