新时代下“村改居”社区如何治理、如何发展,是一个亟待破解的新课题。根据“村改居”社区实践研究,可以认识到这种由政府力量加以推进发展的社区,其制度变迁路径是政府自上而下的创新,而非原生型的社区组织机构,势必造成政府“越位”“缺位”、居民自治环节薄弱、市场参与不充分和具体法制规范缺乏问题。基于此,应以协同治理理论为指导,通过多元主体参与治理、培育社区参与意识、创新社区治理技术、完善法制规范监督等对策以实现政府、居民、市场的良性互动,探求“村改居”社区现代化治理体系的积极方向。

The governance and development of the “village-to-residence” community is a new subject that needs to be given more attention. According to relevant research, it can be found that the path of institutional change of the community, which is promoted by the government, is the “top-down” innovation rather than the original community organizations. It will inevitably lead to the problems of “offside” and “vacancy” of the government, weak link of residents’ autonomy, inadequate market participation and lack of specific legal norms. We should take the theory of collaborative governance as the guidance, and explore the positive reform direction of the modern governance system of “village-to-residence” community, through the countermeasures of multi-subjects participating in governance, cultivating community participation consciousness, innovating community governance technology, and completing legal norms and supervision to realize benign interaction among the government, residents and the market.
