社会法治作为基本法治原则,对立法、行政、司法任务的嬗变产生深远影响。社会法治为解决自由经济社会的弊端、公民基本生存权利的国家保障提供了理论上的正当性与合目的性。社会法治作为特别法治原则,可作为宪法原则使用,其目标在于促成社会安全、社会公平、分配正义。社会法治的行为范式为给付行政,要求国家提供最低限度的生存照顾。社会法治系对自由法治的超越,但不严格适用法律保留原则。

As a basic principle of the rule of law,social rule of law has far-reaching influence on the transformation of legislative,administrative,and judicial tasks.The social rule of law provides theoretical legitimacy and purposefulness in order to solve the shortcomings of the free economic society and the national guarantee of the citizens’ basic living rights.As a special rule of law,the rule of law can be used as a constitutional principle.Its goal is to promote social security,social equity,and justice.The behavioral paradigm of the social rule of law is supply administration and to require the state to provide a minimum of survival care.Social rule of law is a transcendence of the rule of law,but it is not strictly applicable to the principle of legal reservation.
