摘要 教师惩戒是近年来引发社会各界普遍关注的热点问题。合理的教师惩戒既是促进学生发展的有力支撑,也是教师履行管教职责的必然要求。从法治角度审视,当前教师惩戒存在法律规定不明确、法律规范不具体、监督机制不完善等问题。建议给予教师惩戒法律认可,制定教师惩戒实施细则,完善教师惩戒权监督机制等,以进一步促进教师惩戒的合理实现。 Teacher discipline is a hot issue that has caused widespread concern in all sectors of society in recent years. Reasonable teacher discipline is not only a powerful support for the development of students, but also an inevitable requirement for teachers to perform their duties of discipline. From the perspective of the rule of law, there are problems in the current teacher discipline, such as unclear legal provisions, unspecified legal norms and imperfect supervision mechanisms. It is recommended to give teachers disciplinary legal recognition, formulate the detailed rules for the implementation of teacher discipline, and improve the supervision mechanism for teachers’ disciplinary rights to further promote the reasonable realization of teacher discipline.
