法治政府建设的地方经验:法治浙江的实践分析

Local Experience in Construction of Law-based Government: from Perspective of Zhejiang Practice of Rule of Law

"央地互动型"法治遵循着"地方试验―中央认可―稳步推广―法治固化"的发展逻辑,为法治建设开辟了自下而上的本土模式。浙江省"最多跑一次"行政审批制度改革、行政裁量基准制度改革、行政诉讼管辖制度改革、行政复议局模式改革的法治实践,树立了地方政府法治建设典范,组建出一个央地互动的良性改革互动机制,将对未来法治政府建设起到积极的助推作用。在未来法治政府建设过程中,应当鼓励地方的试验创新,及时吸纳央地互动实践经验,助推法治政府建设。

The "central-local interactive" rule of law follows the development logic of "local experiment-central approval-steady promotion-solidification of the rule of law", and opens up a bottom-up local model for the construction of the rule of law.The practice of rule of law in the reform of "running at most once" administrative examination and approval system, the reform of administrative discretion benchmark system, administrative litigation jurisdiction system and administrative reconsideration bureau model in Zhejiang Province, has set up a model of local government’s rule of law construction and a benign reform and interaction mechanism of central-local interaction, which will play a positive role in the future construction of rule of law government. In the process of building a government ruled by law in the future, local experimental innovation should be encouraged, and the experience of interaction between central and local governments should be absorbed in time to promote the construction of a government ruled by law.
