摘要
我国《劳动合同法》第14条第2款第3项规定了用人单位两次定期劳动合同后签订不定期劳动合同的强制缔约义务,自颁布以来饱受争议,分歧在于用人单位是否有选择签订或不签订不定期劳动合同的权利,各地方立法的裁判规则亦存在差异。通过论述该条款的法律适用困境,借鉴域外立法实践,提出完善不定期劳动合同强制缔约的建议,不仅要完善条款自身存在的问题,还应适度放宽解雇保护制度,使两种制度配套发挥立法效用。
It has been always controversial since the compulsory contracting obligation of signing the irregular labor contract is regulated after signing of the twice regular labor contract from the employment unit according to Item3of Paragraph2in Article14 from The Labor Contract Law of China.The divergence is the right for the employment unit to sign the labor contract and there are still differences for the rules of adjudication of the various local legislation.Based on the difficulties in the application of law for this article, the suggestions are proposed to improve the compulsory contracting of the irregular labor contract with the reference of foreign legislation practice.The two systems play legislation function mutually for the disadvantages of the article itself and moderate relaxation of the dismissal protection system.
