从复议应诉角度看林草工作中的法律风险防范

Study of Preventing Legal Risk Related to Forestry and Grassland Work from the Respect of Administrative Reconsideration and Response to Administrative Proceedings

申请行政复议、提起行政诉讼,是公民、法人、其他组织针对行政机关的行政行为,维护自身权益的重要手段。近年来,各级林草部门特别是国家林业和草原局办理行政复议、应诉行政诉讼案件数量大幅增加,这既是全面依法治国进程加快、社会公众法治意识提升的必然结果,也从侧面反映出林草工作依法行政的任务十分艰巨。总体来看,案件集中在作出行政许可、作出行政处罚、履行法定职责、办理信息公开、办理信访事项以及执行规范性文件等领域,程序问题和实体问题交织,法律适用问题和证据认定问题并存。建议,今后从树立法治思维、加快立法步伐、完善内部监督、强化复议应诉协调配合等方面,推动林草系统各项行政管理行为的法治化、规范化建设。

Application of administrative reconsideration and filingof administrative proceedings are key measures for citizens,legal entities and other organizations when they aim to safeguard their own rights and interests referring to administrative organ’s acts.During the recent years,the numbers of cases related to administrative reconsideration and response to administrative proceedings handled by forestry and grassland administrations at all levels especially by national forestry and grassland administration increase at a high rate,which is an inevitable outcome of the acceleration of comprehensive governance by law and promotion of the public’s consciousness of governance by law,and also reflects that the task of implementing law-based administration related to forestry and grassland work is very arduous.Generally speaking,most cases are related to fields such as administrative licensing,administrative penalty,and performance of legal duties,handling of information disclosure,handling of letters and visits and implementation of normative documents.Furthermore,procedural issues and substantial issues interconnect each other,and law implementation issues and evidence recognization issues coexist.It is suggested that the juridification and standardization of all administrative governance acts of forestry and grassland organs be promoted by means of establishing legal way of thinking,accelerating legislation,improving internal supervision and strengthening coordination and harmonization of reconsideration and response to proceedings.
