从挂钩到脱钩:社会治理模式法治化转型研究

From Linkage to Decoupling: A Study on Law Transition of Social Governance Model

在我国,社会治理具有复杂性,因而需要创新治理手段以实现有效治理。挂钩治理模式诞生后,治理主体恣意捆绑法律关系,以变相达到其他治理目标、实现高效治理,导致法律关系界限紊乱、法律责任范围模糊,致使政府治理权威面临严峻挑战。在社会治理法治化的背景下,实现从挂钩治理模式到脱钩治理模式的转变,具有一定必要性与可行性。通过治理主体、治理绩效、法律关系、法律责任多维度脱钩的形式,以厘清治理主体权限、转变治理理念、合理配置权利义务、廓清法律关系界限、明晰法律责任范畴,实现平稳脱钩。

In our country, social governance is complex, so we need to innovate governance means to achieve effective governance. After the emergence of the linked governance model, the governing body arbitrarily bundles legal relations to achieve other governance objectives in disguise and achieve efficient governance, which leads to the disorder of the boundaries of legal relations and the ambiguity of the scope of legal responsibility, thus causing the government governance authority to face severe challenges. Under the background of legalization of social governance, it is necessary and feasible to realize the transformation from the linked governance model to the decoupled governance model. Through the form of multi-dimension decoupling of governance subject, governance performance, legal relationship and legal responsibility, the smooth separation can be achieved by clarifying the jurisdiction of governance subject, changing governance concept, rationally allocating rights and obligations, clearing the boundaries of legal relationship and clarifying the scope of legal responsibility.
