农村土地承包权稳定与调整冲突的实证研究——以武威市为视角

An Empirical Study on the Conflicts between Stability and Adjustment of Rural Land Contract Right——From the perspective of Wuwei

自1993年第二轮土地承包制度实施以来,国家努力保障土地承包权的稳定,但在实践中却存在着村集体随意调整土地承包权的行为,所以土地承包权的稳定问题将是“三农”工作中的重点.作者以武威市农村地区的土地为切入点,对承包权稳定和调整进行了调研,根据调研结果归纳总结了武威市农村土地承包权的调整原因,因“增人不增地、减人不减地”加剧人地矛盾,以及村集体通过村规民约的形式调整土地等,导致国家稳定农村土地承包权的政策陷入困境.因此,作者建议农村土地承包权应根据村集体成员的变动按照法定程序和期限进行调整,当然,还应加强村规民约方面的建设,使得农村土地方面的法律、政策能够“深入”农村.

Since the implementation of the second round of land contracting system,the state has made great efforts to ensure the stability of land contract right,but in practice,the village collectives adjust land contracting right randomly,so the stability of land contracting rights will be the focus of the work concerning“three issues”.Taking the land in the rural area of Wuwei as the breakthrough point,the stabilization and adjustment of the rural landcontractright in Wuweiis investigated,and the reasons for its adjustment are summarizedaccording to the results of the investigation.The contradiction between people and land is aggravated by the rule that the number of people is increasing without increasing the land,the land decreasing whilepopulation is not decreasing,and the collective village adjusts the land according the village regulations,resulting in the national policy of stabilizing the rural land contract right.Therefore,it is suggested that therural land contractright should be adjusted according to the populationchange of the village based on the legal procedures and deadlines.Certainly,the establishment of village rules and regulations should bestrengthened to make the laws and policies concerning rural land can“win support“in the countryside.
