Nomological Paraphrase of the Path of Socialist Rule of Law with Chinese Characteristics

党的十九大报告明确指出,我们要"坚定不移走中国特色社会主义法治道路"。党的领导、中国特色社会主义制度以及中国特色社会主义法治理论这三大核心要义是决定中国特色社会主义法治道路成为我国法治模式的规定性因素,同时党的十八届四中全会提出的五项基本原则背后的精神和理念指明了法治道路的应有之义,确立了党的领导型、人民主体型、法律平等型、德法共治型、法治本土化"五位一体"的中国特色社会主义法治模式。坚持走中国特色社会主义法治道路并非人们臆想的偶然性选择,而是具有法治综合国情范畴内的历史必然性和现实重要性。如果背离我们自己的法治道路,就会导致我国本土化的法治实践缺失对应的理论指导和分析工具,严重阻碍我国法治化进程取得实质性突破。

Report of the 19th National Congress of the Communist Party of China (CPC)clearly states that we should "keep firmly to the path of socialist rule of law with Chinese characteristics".Three core keynotes which include the leadership of the CPC,the system of socialism with Chinese characteristics and the theory of socialist rule of law with Chinese characteristics are prescriptive factors which decide that the path of socialist rule of law with Chinese characteristics becomes our country′s model of rule of law.In the same time,spirits and ideas behind the five cardinal principles which were proposed at the Fourth Plenary Session of the 18th Central Committee of the CPC point out proper meaning of the path of rule of law,and establish the "five-in-one" model of socialist rule of law with Chinese characteristics,which includes the CPC-dominated type,people-oriented type,type of isonomy,type of joint governance of morality and law,and indigenization of ruleoflaw.Adhering to the path of socialist rule of law with Chinese characteristics is not a fancied and accidental choice,but has the historical inevitability and realistic importance in the category of the comprehensive national situation of rule of law.If we depart from our own path of rule of law,it will lead to the lack of theoretical guidance and analytical tools for the localization of rule of law′s practice in our country,and making substantial breakthrough will be severely hampered in the process of our country′s rule of law.
