平台从业人员职业伤害保障制度研究

Research on Occupational Injury Protection System for Platform Workers

平台经济迅猛发展创造了大量就业岗位,但是平台经济的去劳动关系化造成大量平台从业人员被排除在法定工伤保险覆盖范围之外,面临着职业伤害风险无从保障的问题。本文在总结分析灵活就业人员工伤保障地方试点探索和欧盟自雇者工伤保障经验的基础上,基于平台从业人员权益保障和工伤保险制度的长远发展,针对建立平台从业人员职业伤害保障制度提出了关于职业伤害保障模式、制度发展定位、制度框架等方面的设想。

The rapiddevelopment of the platform economy has created a large number of jobs, but lackof traditional industrial relationship has caused many platform workers to beexcluded from the coverage of statutory work injury insurance. On the basis of summarizing and analyzing the local pilot exploration of f lexible employment injury protection and the experience of EU self-employed workers' injury protection, this paper proposes on the establishment of platform occupational injury insurance system. To benefit the protection of platform workers' rights and long-term development of work injury insurance system, occupational injury protection models, institutional development orientation, and institutional framework are designed.
