出现跨境零售商品检验问题的法律研究——基于快件通关视角

Legal Research on Cross-border Retail Commodity Inspection:from the Perspective of Express Clearance

商贸国际化是中国现阶段发展的重要趋势,跨境零售商品也越来越受到消费者的青睐。但是国内快件通关海关检验程序松散,境内消费者追偿成本高,司法执行效率低,侵害消费者利益事件时有发生。国务院各部门联合制订的消费者对跨境消费零售商品自负其责的通知,显然有不妥之处。鼓励跨境零售商品保税通关模式代替快件通关模式是严把境内商品质量安全关的重要途径,能够最终保护消费者的合法权益。

Trade internationalization is an important trend in China’s current development, and cross-border retail goods are increasingly favored by consumers. However, the customs inspection procedures of domestic express are not very rigorous, the recovery cost of domestic consumers is high, and the judicial execution is inefficient, eventually, consumers’ interests are encroached from time to time. However, the notice jointly formulated by various departments of the State Council that consumers should assume self-responsibility for cross-border retail consumption is obviously contrary to the public opinion and interests. Therefore, encouraging cross-border retail bonded customs clearance mode to replace the mode of express customs clearance is an important way to strictly control the quality and safety of imported goods and ultimately protect the legitimate rights and interests of consumers.
