A Study of the Legal Narration of Alexander Radishchev’s Literary Works

拉吉舍夫是18世纪俄国一位具有法学修养的作家,他在自己所攻读的法学专业毫无用武之地的情况下,通过《从彼得堡到莫斯科旅行记》等文学作品表达自己的具有强烈的民主意识的法学思想。他关注法律问题,书写法律事件,批判法律的不公,抒发法律理想,而且,他的法律书写具有强烈的问题意识,他在作品中以具体的司法案件为例,突出反抗暴政、为民造福的法律理念。尽管他为此受到叶卡捷琳娜二世的迫害,但他坚守自己的理想和信念。拉吉舍夫的《从彼得堡到莫斯科旅行记》等文学作品,不仅是文学史上的杰作,而且在呼唤法律正义、弘扬民主和法制等方面,无疑具有重要的文献价值,同时也是文学法律批评的优秀文本。

Alexander Radishchev was the 18th century Russian writer with Law cultivation. Under the circumstances of the uselessness of his law majoring, he expressed his law thoughts and his deep democratic consciousness through his literary works such as Journey from St. Petersburg to Moscow. He paid special attention to the legal matters, wrote about the legal cases, criticized the unfairness of the law system, and declared his own ideal legal thoughts. Furthermore, his legal narration has a strong sense of the problem. In order to emphasize his legal ideas characterized by the anti-tyranny and bringing benefits to the people, he attempted to use the individual cases as the typical examples. Although he suffered a lot from the Empress Catherine the Great because of his writing, he stood still to his ideal and his belief. His literary works such as Journey from St. Petersburg to Moscow are not only the masterpieces in the history of Russian literature, but also of great significance for us to carry forward the justice of law, to cultivate the democracy and to strengthen the law system. Meawhile, it is a splendid text for legal literary criticism.
