Defects and Construction: The Rule System in the Process of China’s Modernization

在中国现代化进程中,社会规则体系逐步建立,但也存在规则体系缺损的问题,表现在:就国内而言,形式上,规则体系不够完善,不同规则彼此冲突;内容上,一些规则内容滞后,一些规则操作性不强。就国际而言,还遭遇国际规则冲突和霸权规则。规则体系缺损原因是多线的,既有人自身的原因,也有社会原因;既有历史的也有现实的,诸如社会变化迅速,主体认识欠缺等。建构公平规则体系,我们需要古为今用,洋为中用,推陈出新,抓紧建立、废除、改革、创新规则体系,搞好顶层设计,重点突出,整体推进,并且重视国际规则参与、保留和重塑,建设公正的全球治理体系和现代治理能力,维护国家利益。

In the process of China’s modernization, the social rule system has been gradually established, but there are also defects, as is manifested in following aspects: domestically, as regards the pattern, the rule system is not perfect enough, and various rules conflict with each other;and in terms of the content, some rules are lagging behind and contradictory to each other while others are not operative. Internationally, the rule system may also run up against international rules and hegemonic rules. The defects in the rule system are caused by multiple factors, both human and social as well as historical and realistic, such as the rapid social change, and the lack of awareness on the part of the subject, etc. To build a system of fair rules, we need to make the past serve the present and the foreign serve the Chinese. Meanwhile, we will remove the old and bring forth the new, promptly establish, abolish, reform and innovate a system of rules, do a good job in the top-level design, focus on key areas, and promote overall progress. Furthermore, importance will be attached to the participation, retention and remodeling of international rules so as to build a just global governance system and capacity and to safeguard national interests.
