“一带一路”背景下内蒙古自治区对外贸易法律问题及对策

Legal Issues and Solutions of Inner Mongolia Autonomous Region’s International Trading Under “One Belt and Road” Strategy

作为"一带一路"最北端通道的"草原丝绸之路"经济带连接着我国、俄罗斯、蒙古国以及中亚、西亚和东欧国家。推动"草原丝绸之路"经济带的建设,促进"草原丝绸之路"经济带国家间的经贸合作,对于我国北疆的经济发展乃至国家安全都有重要的意义。但"一带一路"沿线国家的政治环境、经济发展水平以及法律制度各有差异,我国企业和投资者难免会因为东道国政策变动、环境保护、知识产权等因素而遇到法律问题。本文以内蒙古自治区为例,旨在探讨我国企业和投资者在参与"一带一路"建设时可能面临的法律问题,以及从国家层面和企业层面可以采用的应对措施,更好地保护我国企业和投资者的利益,推动"一带一路"的建设。

"Grassland Silk Road", as the northern path of "The Belt and Road", connects China, Russia, Mongolia, Mid-Asia, Western Asia and Eastern European countries. Building "Grassland Silk Road" and encouraging international business and trading among the countries alongside "Grassland Silk Road" will have great significance for economics and national security of China. However, there are differences of politics, economics, legal systems in the countries alongside "The Belt and Road", thus Chinese corporations and investors may run into legal issues due to policy change, environment protection, and intellectual property issues. This paper will use Inner Mongolia Autonomous Region as an example, and discuss the legal issues that Chinese corporations and investors may run into. This paper will also discuss the solutions that China and Chinese corporations may take,which will protect Chinese corporations’ and investors’ interests better and promote "The Belt and Road".
